Don’t Let Our Right To Privacy Expire

As your life moves online, the American government is trying to deny your basic rights.
It doesn't have to be this way.

What is the Fourth Amendment?

It’s the part of the Constitution that keeps the government from invading your privacy for no reason. If the police, the IRS, or the FBI want to search your home, they need a good reason, and — except in exceptional circumstances — a judge's permission.

Does it protect us online?

Yes! And the courts increasingly agree. But the US Department of Justice claims the Fourth Amendment does not require a warrant to search webmail, texts, Facebook messages, Google Docs, Dropbox documents and anything else in the cloud. This needs to stop!

Why now?

Because each day more of our private communications go into the cloud, where the government claims we have no Fourth Amendment rights. Congress knows there's a problem (it's common sense!) but it won't act without a push from voters.

What is this all about?

Our rights are in danger. The Bill of Rights was intended to grant all Americans protection from unreasonable government intrusions into our lives. Two decades ago, Congress recognized that the courts were not keeping up with the times, so it passed a law to preserve privacy rights in electronic communications. The 1986 law made some critical reforms, but came from an era with no Google, no Facebook, no World Wide Web. Now, that law needs to be updated to ensure that our rights don’t vanish as our lives move into the cloud.

That sounds scary. Tell me more.

Right now, the government claims that the Constitution does not protect the privacy of communications, calendars, photos and documents stored online. That 1986 federal privacy law provides some protections, but it has crazy distinctions like one rule for email more than 180 days old (no warrant required) and a different rule for email 180 days old or less (warrant required). Bottom line: the statute says the government can read a lot of your most personal stuff without a warrant. That doesn’t make any sense.

And the 1986 law didn’t even address location information, so the government claims that it can track your location using your phone without ever going to a court and getting a warrant from a judge. Congress has failed to pass common sense updates to that outdated 1986 law to ensure that privacy protections you get in your home apply equally to the Internet

But that just seems ridiculous!

It is ridiculous. Congress has acknowledged in the past that legislation must be updated to keep pace with technology in order to protect the original meaning of the Constitution. In 1986 it passed the Electronic Communications Privacy Act (ECPA). Congress thought that provisions such as the “180 day rule” made sense at the time, since most companies didn’t store your email even for six months. (In 1986, most customers downloaded their email to their personal computer, where, by the way, the government agrees it is protected by the Constitution.)

Why is Privacy Important?

Privacy isn’t just important. Privacy is AWESOME. Privacy means you can be yourself. You can express ideas without fear of being unjustly punished or discriminated against. It's your life without pausing to think if the government is watching. Privacy keeps you safe. It's a core principle in any free society.

Online privacy is also important to American businesses who are increasingly moving their sensitive information from paper files to “cloud storage” in order to compete in a rapidly changing economy. Outdated privacy laws create uncertainty that harms the growth of small businesses. A recent study by the Pew Research Group reported that 71% of IT experts think that most people and businesses will do their work almost exclusively in “The Cloud” by 2020. This is a $250 billion industry already, but if we don’t update privacy laws to provide online customers of these American innovators with the same legal protections they could get off-line, we risk losing thousands of jobs — and our ability to compete in the global marketplace.

It is not the only dangerous thing out there. What should we do, hold tight to our beloved and soon old fashion hard disks and do not let go ? What is the alternative?

If the law changes America will be able to read everything everywhere and nothing will be safe X(

I do not use clouds or wireless 'When it's in the air it's everywhere'

People invent all these new ways for us to communicate then they take away our rights to privacy X(

We have CIA using facebook and other social networks to watch us. Google keeping and sharing all our information

I never use google - not safe enough for me

We have to make our computers as secure as possible

Hard disks are safe I still use them instead of a cloud

The only thing in clouds near me is rain :ymdevil:
