Elections registration deadline

ERBIL (Kurdistan24) – A deadline for submitting candidates for the Kurdistan Region parliamentary elections was announced by the Iraqi Independent High Electoral Commission (IHEC) on Sunday

IHEC spokesperson Jumana al-Ghalai told Kurdistan24 that candidates are welcome to participate in the parliamentary elections between March 13 and March 22.

Kurdistan Region President Nechirvan Barzani on March 3, set June 10 for parliamentary elections.

Due to political infighting, the Kurdistan Region parties could not agree on amending the election law last year, triggering the extension of the current Kurdistan Parliament term by a year.

The Iraqi Supreme Court in August 2023, issued its verdict on the extension, calling it “unconstitutional.”

Kurdistan Region Prime Minister Masrour Barzani and President Nechirvan Barzani have reiterated their calls for holding the elections on time and without further delay.

The United Nations Assistance Mission for Iraq (UNAMI) has also called on the political parties to hold the polls on time.

On Feb. 21, the Federal Supreme Court of Iraq ruled to decrease the Kurdistan Region parliament seats from 111 to 100. Those eleven seats were dedicated to Kurdistan Region minorities.

Every four years, Kurdistan Region parliamentary elections are held to elect the 111 members. The election was first held in 1992 and the most recent election was held in 2018.

Dawid Salman, the Director of the IHEC, previously told Kurdistan24 that there are 3.6 million eligible voters in the Kurdistan Region.

Kurdistan Won't Abandon Rights

Kurdistan Prime Minister Masrour Barzani on Wednesday received British Ambassador to Iraq Stephen Hitchen to discuss relations between Erbil and Baghdad

During the meeting, the Kurdish leader reaffirmed his cabinet's commitment to protecting Kurdistan Region's constitutional rights and entitlements regardless of pressure.

Discussions also revolved around ongoing Peshmerga reforms as well as the rights of ethnic and religious components living in the Region, including the right for a fair representation.

Increase Halabja seat count

The Kurdistan Democratic Party (KDP) has asked the Iraqi electoral body to review and increase the number of seats allocated for Halabja province for the upcoming Kurdistan Region elections, the body’s spokesperson told Rudaw on Wednesday

Unlike in previous elections, which followed a single constituency system, the June vote will see the Kurdistan Region divided into four constituencies. Sulaimani will have the most number of seats with 38, followed by Erbil with 34, Duhok with 25, and Halabja with three.

Jumana al-Ghalai, spokesperson of Iraq's Independent High Electoral Commission (IHEC), told Rudaw’s Nahro Mohammed that the KDP has submitted a request to the IHEC to increase Halabja’s seats, adding that the body has not yet provided an official response. She stressed that the decision is not in their hands.

“The Federal Supreme Court rules on how the seats should be divided, not the commission. That is why the seats cannot be changed, because the Federal Supremes’ Court’s decision is final, cannot be appealed, and all must follow,” said Ghalai.

The division into four constituencies came as part of Iraq’s top court’s February ruling which found the 11 quota seats reserved for ethnic and religious minorities in the Kurdistan parliament to be “unconstitutional”, effectively eliminating them.

The Kurdistan Region Judicial Council said in a statement on Wednesday that changing the number of seats in the Kurdistan parliament is not within the Federal Supreme Court’s jurisdiction, as the Iraqi constitution recognizes the Region and its existing authorities.

“The constitution has recognized that Kurdistan Region’s laws need to be prioritized in case of a contradiction or a disagreement with the federal laws… The Federal Court has made itself the legislator through amending the seats of the Kurdistan parliament,” read a statement from Abdul-Jabbar Aziz Hassan, head of the Kurdistan Region Judicial Council.

In the statement, he cited Article 117 of the Iraqi constitution, which recognized the Kurdistan Region and its existing authorities as a federal region, as well as Article 115 which states that “all powers not stipulated in the exclusive powers of the federal government belong to the authorities of the regions and governorates that are not organized in a region. With regard to other powers shared between the federal government and the regional government, priority shall be given to the law of the regions and governorates not organized in a region in case of dispute.”

Hassan stressed that the Federal Supreme Court does not have the power to amend constitutional articles or attempt to violate and create problems for them through baseless excuses. Additionally, he claimed that the establishment of Federal Supreme Court is unconstitutional itself, citing Article 92 which defines the court as an “independent judicial body, financially and administratively.”

The June 10 election will be unique in Kurdistan Region’s parliamentary history, with fewer seats in the legislature, a new constituency system, and the poll being administered by the federal commission for the first time due to disagreements between the main Kurdish parties that resulted in the failure to reactivate the regional electoral body.

The election is taking place with about a year and a half delay. It was initially scheduled for October 2022, but was repeatedly postponed because of disagreements between the political parties and pending court cases in Baghdad.

KDP says will not participate in elections

The Kurdistan Democratic Party (KDP) on Monday announced that it will not be participating in the upcoming Kurdistan Region parliamentary elections, labeling it “illegal” and “unconstitutional”, following the ruling from Iraq’s top court to eliminate minority quota seats from the Kurdish legislature

Iraq’s Federal Supreme Court last month ruled that the 11 quota seats in the Kurdistan Region’s parliament reserved for ethnic and religious minorities were unconstitutional, effectively eliminating the seats.

The KDP "will not partake in an illegal and unconstitutional election under an imposed system,” read a statement from the party’s political bureau on Monday.

The KDP politburo said that the ruling was a continuation of the court’s “unconstitutional rulings against the Kurdistan Region in the past four years,” labeling it “a clear and dangerous violation of the constitution” and an attempt to “return Iraq to a centralized system.”

The statement noted that the KDP is confident that it continues to be the number one party in the Kurdistan Region, but stressed that the decision to not participate in the elections was made out of a sense of responsibility towards preserving the rights of the people of the Kurdistan Region and the democratic and federal system in Iraq.

“The KDP has always been an advocate for providing the principles and criteria for free and fair elections, which include, at least, the existence of a fair electoral law that guarantees the representation of all classes and communities of Kurdistan,” the statement added, claiming that eliminating the minority seats is a violation of the people’s will.

The statement cites multiple Articles of the Iraqi constitution which recognize the Kurdistan Region and its existing authorities as a federal region, and prioritizes the Region’s laws over the federal government in cases of dispute and cases where powers are not stipulated to be exclusive to the federal government.

“We believe it is in the interest of our people and homeland that our KDP does not succumb to the implementation of an unconstitutional ruling and an imposed system outside the will of the people of the Kurdistan Region and its constitutional institutions.”

The party also threatened that it would not be able to continue in the political process in Baghdad, if the State Administration Coalition does not uphold its national responsibilities of implementing the constitution and meet the political and administrative agreements of forming the current Iraqi government, headed by Prime Minister Mohammed Shia’ al-Sudani.

The June 10 election will be unique in the Kurdistan Region’s parliamentary history, with fewer seats in the legislature, a new constituency system, and the poll being administered by the federal commission for the first time due to disagreements between the main Kurdish parties that resulted in a failure to renew the mandate of the regional electoral body as required by law.

The February ruling also divided the Kurdistan Region into four constituencies - Duhok, Erbil, Sulaimani, and Halabja - instead of the single-constituency system adopted in previous elections. The Patriotic Union of Kurdistan (PUK) stronghold Sulaimani is the most populous province and it will have the most seats in the parliament, with 38.

PUK leader TRAITOR Bafel Talabani on Saturday stated that the Kurdistan Region’s upcoming parliamentary election will be “more democratic.”

Several Turkmen and Christian parties have also previously declared that they will not be partaking in the June 10 elections in light of the court's ruling.

Lawmakers from the minority quota in the Kurdish and Iraqi parliaments are often criticized for not being the true faces of the populations they represent but rather agents of ruling parties.

Winning minority candidates with external party affiliations often receive tens of thousands of votes from districts in which the community has very minimal to no presence in, as big parties often mobilize scores of loyalists to tip these candidates over the line.

The KDP has been repeatedly accused by rival parties of using the minority seats for its own advantage.

Kurdistan Prime Minister Masrour Barzani on Tuesday invited observers from around the world to monitor Kurdistan Region's upcoming elections in order to secure a "transparent" process

Barzani received the United Nations Assistance Mission for Iraq (UNAMI) Head Jeanine Hennis-Plasschaert in Erbil on Tuesday.

Most political parties submitted their candidate lists, excluding the ruling Kurdistan Democratic Party (KDP), which earlier this month announced it was boycotting the vote in protest over a federal court ruling that eliminated minority quota seats and imposed a four-constituency system.

Electoral Fraud Ahead of Elections

The Kurdistan Democratic Party (KDP) has launched an intel investigation into a significant number of its members whose fingerprints are not recognized by the Independent High Electoral Commission (IHEC)

According to the preliminary results, out of a total of 400,000 unrecognized individuals, 200,000 are members of the KDP, with 160,000 of them located in Sulaimaniyah.

Shuan Kalari, a prominent figure within the KDP faction, disclosed to VOA Kurdish that the party has identified these individuals through an extensive database of its members' fingerprints available at the IHEC, which were not recognized by the commission.

Kalari emphasized that despite the propaganda campaign targeting the KDP, claiming some of these individuals are refugees from Syria and Iran, the majority are indeed members of the KDP, with a significant portion residing in Sulaimaniyah.
