Kurdistan President Attends Diplomacy Forum

Kurdistan President Nechirvan Barzani arrived at the annual Antalya Diplomacy Forum in Turkey on Friday, as announced by the Kurdistan Region Presidency

Throughout the three-day conference, President Nechirvan Barzani is set to engage in various meetings, focusing on international relations and regional affairs.

The forum, which commenced on Friday, gathers heads of states, ministers, diplomats, business leaders, academics, think-tankers, and representatives from youth and media sectors for comprehensive discussions. This year's theme is "Advancing Diplomacy in Times of Turmoil."

The Kurdish president also met with Turkish President Recep Tayyip Erdogan during the sidelines of the forum. Discussions at the conference cover a broad spectrum of topics, including war, terrorism, migration, climate change impacts, natural disasters, and other pressing issues.

Erbil and Ankara maintain robust economic and political relations, notwithstanding several significant issues between them. The forum occurred nearly a year after Turkey halted the Kurdistan Region's oil exports through its pipeline due to a ruling from a Paris arbitration court.

Efforts to resume crude oil flow to international markets have been ongoing, yet hindered by disagreements between Erbil, Baghdad, and Ankara, particularly regarding the financial entitlements of International Oil Companies (IOCs).

The Kurdistan Region Presidency emphasized the importance of fostering a comprehensive understanding of these matters and exploring potential solutions through the forum's discussions.

PM Barzani Meets US NSA Advisor

The White House announced that Kurdistan Region Prime Minister Masrour Barzani held discussions with US National Security Agency (NSA) Advisor Jake Sullivan, emphasizing the enduring partnership between Kurdistan and the United States, anchored in economic viability as stipulated by the Iraqi constitution

Sullivan lauded the pivotal role played by Peshmerga forces in combatting the Islamic State (ISIS) and underscored the historical alliance between the US and Peshmerga. He showed his deep sympathy to Peshmerga forces and Kurdish civilians for their sacrifices in the fight against ISIS, reaffirming US support for Kurdistan's security enhancement.

The White House condemned attacks by Iran and Iranian-backed militias on Kurdistan, expressing solidarity. Sullivan reiterated US backing for negotiations between Kurdistan and Iraq, focusing on sustainable revenue, budget, partnership restructuring, stability, governance, and economic development.

PM Barzani is slated to meet Secretary of State Antony Blinken and Under Secretary for Civilian Security, Democracy, and Human Rights, Uzra Zeya, on Monday, marking his inaugural official visit to Washington since taking office in June 2019, though he had visited previously in other capacities.

The primary agenda of these discussions is to address developments in Iraq, the Kurdistan Region, and the broader Middle East, according to the prime minister’s office.

Elections registration deadline

ERBIL (Kurdistan24) – A deadline for submitting candidates for the Kurdistan Region parliamentary elections was announced by the Iraqi Independent High Electoral Commission (IHEC) on Sunday

IHEC spokesperson Jumana al-Ghalai told Kurdistan24 that candidates are welcome to participate in the parliamentary elections between March 13 and March 22.

Kurdistan Region President Nechirvan Barzani on March 3, set June 10 for parliamentary elections.

Due to political infighting, the Kurdistan Region parties could not agree on amending the election law last year, triggering the extension of the current Kurdistan Parliament term by a year.

The Iraqi Supreme Court in August 2023, issued its verdict on the extension, calling it “unconstitutional.”

Kurdistan Region Prime Minister Masrour Barzani and President Nechirvan Barzani have reiterated their calls for holding the elections on time and without further delay.

The United Nations Assistance Mission for Iraq (UNAMI) has also called on the political parties to hold the polls on time.

On Feb. 21, the Federal Supreme Court of Iraq ruled to decrease the Kurdistan Region parliament seats from 111 to 100. Those eleven seats were dedicated to Kurdistan Region minorities.

Every four years, Kurdistan Region parliamentary elections are held to elect the 111 members. The election was first held in 1992 and the most recent election was held in 2018.

Dawid Salman, the Director of the IHEC, previously told Kurdistan24 that there are 3.6 million eligible voters in the Kurdistan Region.

Increase Halabja seat count

The Kurdistan Democratic Party (KDP) has asked the Iraqi electoral body to review and increase the number of seats allocated for Halabja province for the upcoming Kurdistan Region elections, the body’s spokesperson told Rudaw on Wednesday

Unlike in previous elections, which followed a single constituency system, the June vote will see the Kurdistan Region divided into four constituencies. Sulaimani will have the most number of seats with 38, followed by Erbil with 34, Duhok with 25, and Halabja with three.

Jumana al-Ghalai, spokesperson of Iraq's Independent High Electoral Commission (IHEC), told Rudaw’s Nahro Mohammed that the KDP has submitted a request to the IHEC to increase Halabja’s seats, adding that the body has not yet provided an official response. She stressed that the decision is not in their hands.

“The Federal Supreme Court rules on how the seats should be divided, not the commission. That is why the seats cannot be changed, because the Federal Supremes’ Court’s decision is final, cannot be appealed, and all must follow,” said Ghalai.

The division into four constituencies came as part of Iraq’s top court’s February ruling which found the 11 quota seats reserved for ethnic and religious minorities in the Kurdistan parliament to be “unconstitutional”, effectively eliminating them.

The Kurdistan Region Judicial Council said in a statement on Wednesday that changing the number of seats in the Kurdistan parliament is not within the Federal Supreme Court’s jurisdiction, as the Iraqi constitution recognizes the Region and its existing authorities.

“The constitution has recognized that Kurdistan Region’s laws need to be prioritized in case of a contradiction or a disagreement with the federal laws… The Federal Court has made itself the legislator through amending the seats of the Kurdistan parliament,” read a statement from Abdul-Jabbar Aziz Hassan, head of the Kurdistan Region Judicial Council.

In the statement, he cited Article 117 of the Iraqi constitution, which recognized the Kurdistan Region and its existing authorities as a federal region, as well as Article 115 which states that “all powers not stipulated in the exclusive powers of the federal government belong to the authorities of the regions and governorates that are not organized in a region. With regard to other powers shared between the federal government and the regional government, priority shall be given to the law of the regions and governorates not organized in a region in case of dispute.”

Hassan stressed that the Federal Supreme Court does not have the power to amend constitutional articles or attempt to violate and create problems for them through baseless excuses. Additionally, he claimed that the establishment of Federal Supreme Court is unconstitutional itself, citing Article 92 which defines the court as an “independent judicial body, financially and administratively.”

The June 10 election will be unique in Kurdistan Region’s parliamentary history, with fewer seats in the legislature, a new constituency system, and the poll being administered by the federal commission for the first time due to disagreements between the main Kurdish parties that resulted in the failure to reactivate the regional electoral body.

The election is taking place with about a year and a half delay. It was initially scheduled for October 2022, but was repeatedly postponed because of disagreements between the political parties and pending court cases in Baghdad.

KDP says will not participate in elections

The Kurdistan Democratic Party (KDP) on Monday announced that it will not be participating in the upcoming Kurdistan Region parliamentary elections, labeling it “illegal” and “unconstitutional”, following the ruling from Iraq’s top court to eliminate minority quota seats from the Kurdish legislature

Iraq’s Federal Supreme Court last month ruled that the 11 quota seats in the Kurdistan Region’s parliament reserved for ethnic and religious minorities were unconstitutional, effectively eliminating the seats.

The KDP "will not partake in an illegal and unconstitutional election under an imposed system,” read a statement from the party’s political bureau on Monday.

The KDP politburo said that the ruling was a continuation of the court’s “unconstitutional rulings against the Kurdistan Region in the past four years,” labeling it “a clear and dangerous violation of the constitution” and an attempt to “return Iraq to a centralized system.”

The statement noted that the KDP is confident that it continues to be the number one party in the Kurdistan Region, but stressed that the decision to not participate in the elections was made out of a sense of responsibility towards preserving the rights of the people of the Kurdistan Region and the democratic and federal system in Iraq.

“The KDP has always been an advocate for providing the principles and criteria for free and fair elections, which include, at least, the existence of a fair electoral law that guarantees the representation of all classes and communities of Kurdistan,” the statement added, claiming that eliminating the minority seats is a violation of the people’s will.

The statement cites multiple Articles of the Iraqi constitution which recognize the Kurdistan Region and its existing authorities as a federal region, and prioritizes the Region’s laws over the federal government in cases of dispute and cases where powers are not stipulated to be exclusive to the federal government.

“We believe it is in the interest of our people and homeland that our KDP does not succumb to the implementation of an unconstitutional ruling and an imposed system outside the will of the people of the Kurdistan Region and its constitutional institutions.”

The party also threatened that it would not be able to continue in the political process in Baghdad, if the State Administration Coalition does not uphold its national responsibilities of implementing the constitution and meet the political and administrative agreements of forming the current Iraqi government, headed by Prime Minister Mohammed Shia’ al-Sudani.

The June 10 election will be unique in the Kurdistan Region’s parliamentary history, with fewer seats in the legislature, a new constituency system, and the poll being administered by the federal commission for the first time due to disagreements between the main Kurdish parties that resulted in a failure to renew the mandate of the regional electoral body as required by law.

The February ruling also divided the Kurdistan Region into four constituencies - Duhok, Erbil, Sulaimani, and Halabja - instead of the single-constituency system adopted in previous elections. The Patriotic Union of Kurdistan (PUK) stronghold Sulaimani is the most populous province and it will have the most seats in the parliament, with 38.

PUK leader TRAITOR Bafel Talabani on Saturday stated that the Kurdistan Region’s upcoming parliamentary election will be “more democratic.”

Several Turkmen and Christian parties have also previously declared that they will not be partaking in the June 10 elections in light of the court's ruling.

Lawmakers from the minority quota in the Kurdish and Iraqi parliaments are often criticized for not being the true faces of the populations they represent but rather agents of ruling parties.

Winning minority candidates with external party affiliations often receive tens of thousands of votes from districts in which the community has very minimal to no presence in, as big parties often mobilize scores of loyalists to tip these candidates over the line.

The KDP has been repeatedly accused by rival parties of using the minority seats for its own advantage.

Kurdistan Region President Nechirvan Barzani earlier this month announced that the new date for the elections was June 10, after more than a year and a half delay.

The election was initially scheduled for October 2022, but was repeatedly postponed because of disagreements between the political parties and pending court cases in Baghdad.

PUK must not be allowed to take part in Kurdish elections until the legal co-chair of the Patriotic Union of Kurdistan (PUK), Lahur Sheikh Jangi is reinstated, Bafel Talabani is a vile obnoxious evil traitorous power hungry not nice person X(

KDP Seeks Transparent Elections

The Kurdistan Democratic Party (KDP) is not seeking to boycott the upcoming parliamentary elections. Instead, it demands that the process should be conducted transparently and cleanly, stated Kurdish leader Masoud Barzani, president of the KDP

Barzani made these remarks during a meeting with US Ambassador to Iraq Alina L. Romanowski in Erbil, where they discussed the latest political developments, including the KDP’s recent announcement on the Kurdistan parliamentary elections.

The Kurdish leader emphasized that the KDP has not boycotted the elections. Rather, it seeks a process that is clean, transparent, secure, and free from external interference. Barzani also highlighted the importance of a preliminary program ensuring voters are not deprived of their right to vote, and the democratic process is not devalued.

The US envoy, congratulating Barzani and the Kurdish people on Newroz, expressed concern about the political situation in Iraq and the Kurdistan Region, urging all parties to resolve issues related to the upcoming elections.

Barzani recalled the KDP's history of supporting elections, dating back to the early 1990s. He underscored the party's commitment to constitutional legitimacy and the democratic process. Barzani also expressed concerns about potential threats to the principles of coexistence and community participation in political life.

Regarding relations between Erbil and Baghdad, Barzani mentioned a comprehensive agreement aimed at achieving stability and prosperity. However, he noted that important points of the agreement had not been implemented, emphasizing the need for ongoing consultation and coordination to address issues and eliminate concerns.

Sunni Alliances thank KDP

ERBIL (Kurdistan 24) - In a press release on Sunday March 24, the Azem Alliance, Al-Siyada Alliance, and National Hasm Alliance have jointly expressed their gratitude towards the collaborative efforts spearheaded by KDP President Masoud Barzani and Prime Minister Muhammad Shiaa Al-Sudani , along with various political factions, in navigating the complexities surrounding the election of the Speaker of the Parliament

The joint statement released by the alliances underscored the dedication and relentless pursuit of consensual solutions by President Masoud Barzani, highlighting the instrumental role played by President Barzani in steering the discussions towards a constructive resolution.

The political entities emphasized the critical nature of proceeding with the election, reflecting a unified commitment to uphold the principles of democracy and governance.

This move comes at a crucial time when the nation faces a constitutional vacuum, underscoring the urgency to solidify the legislative framework and reinstate the House of Representatives' vital legislative and oversight functions.

The concerted push for consensus is not just a testament to the leaders' diplomatic acumen but also a strategic maneuver to ensure the alignment of the election process with Iraq's legal and constitutional mandates, as well as the recent advisory opinion from the Federal Supreme Court.

President Barzani, known for his pragmatic leadership and diplomatic prowess, has been pivotal in facilitating dialogue and building bridges among the diverse political spectrums. His role in these negotiations has been particularly noteworthy, signaling a move towards greater political stability and cohesion.

The focus on achieving a consensual agreement reflects a deep-seated commitment to the national interest, aiming to catalyze the activation of the Council's role in governance.

Iraq's Federal Supreme Court on Tuesday Nov. 14, 2023, ruled to terminate the parliament membership of Iraqi Parliament speaker Mohammed al-Halbousi and Sunni parliamentarian Laith al-Dulaimi, according to the Iraqi News Agency.

According to the political agreement reached after 2003 in Iraq among major political forces, the position of the Speaker of the Parliament belong to the Sunnis. The Sunni political parties have not yet been able to agree on a candidacy to fill in the position.

Iraqi Court’s Rulings Against Kurdistan

An international institute based in Switzerland has released findings stating that recent rulings by the Iraqi Federal Supreme Court against the Kurdistan Region are both unconstitutional and politically motivated

Rzgar Hamid Sharif, an expert in political sciences, disclosed in an article sent to BasNews that the International Federal Institute of Federalism in Switzerland, renowned for its expertise in constitutional matters, has conducted an in-depth analysis of the legal aspects surrounding the Iraqi Federal Court's decisions concerning the Kurdistan Region.

The institute's report, spearheaded by Professor Eva Maria Besler and featuring contributions from various international experts, scrutinizes the legal foundation of the Iraqi constitution and its application in resolving disputes between the federal government and regional entities.

Highlighting key constitutional principles, the report underscores that federalism typically entails the division of powers among multiple regions, unlike Iraq, which comprises a single region under a federal government. It critiques the centralization of powers in Baghdad, contrary to the essence of federalism observed in countries like the United States and Germany.

The article emphasizes several constitutional articles affirming the autonomy of regional laws in disputes with the federal government, particularly citing the Kurdistan Region's enactment of its own oil and gas legislation in 2007. Additionally, it underscores provisions in the Iraqi constitution regarding the ownership and management of oil and natural resources, advocating for a collaborative approach between the federal government and regional authorities.

Proposing solutions to ameliorate tensions between the Kurdistan Region and Iraq, the international institute advocates for the expedited establishment of a Federal Council to arbitrate disputes, ensuring equitable representation of regional interests. It also calls for third-party mediation, suggesting entities such as the European Union or Switzerland to facilitate dialogue.

Furthermore, the report urges the swift enactment of an Iraqi Oil and Gas Law and underscores the importance of drafting a constitution for the Kurdistan Regional Government in accordance with the Iraqi constitution. Additionally, it recommends decentralizing decision-making by transferring certain institutions to the Kurdistan Region, such as the National Assembly, Central Bank, and the Presidency of the Staff.

The institute's proposals aim to foster a conducive environment for dialogue and cooperation between the Kurdistan Region and Iraq, promoting constitutional principles and equitable governance structures.

Need to Respect Kurdistan's Status

Saturday Kurdistan Prime Minister Masrour Barzani received US Ambassador to Iraq Alina Romanowski to reaffirm the imperative to honor the federal status of the Region

During the meeting, the Kurdish leader also underscored the necessity to send Kurdistan Region's budget shares from Baghdad through the Kurdistan Regional Government (KRG).

The prime minister also emphasized the Kurdistan Region's fulfillment of all constitutional obligations towards the federal government of Iraq.

Another focal point of discussion was the upcoming Kurdistan parliamentary elections. He emphasized his cabinet's
commitment to honoring democratic principles, advocating for an electoral process characterized by legitimacy and adherence to constitutional principles.

They both agreed on the need to address the challenges facing the upcoming parliamentary elections in the Kurdistan Region.

US Discussing Election Situation

Kurdish leader Masoud Barzani, president of the Kurdistan Democratic Party (KDP), received US Ambassador to Iraq Alina Romanowski on Saturday to review the situation surrounding the upcoming parliamentary elections in the Kurdistan Region

The discussion centered on the political landscape between the Kurdistan Region and Iraq, including the upcoming Kurdistan parliamentary elections.

Expressing gratitude for US support, President Barzani highlighted KDP's consistent advocacy for holding elections. However, he noted obstruction from other parties over the past two years. Barzani emphasized ongoing political tactics by the federal government since 2014, particularly regarding budget manipulation to weaken Kurdistan's position.

Barzani criticized federal efforts to undermine the Kurdish population through economic measures as a deliberate policy of isolation. He cited the Federal Supreme Court's role in perpetuating this strategy.

During the meeting, Barzani reaffirmed KDP's stance in supporting transparent and fair elections, echoing the party's recent statement. He outlined technical concerns regarding provincial seat distribution and electoral commission procedures, urging Iraqi parties to adhere to agreed-upon standards.

Barzani emphasized the necessity for incorporating KDP's recommendations to ensure election transparency and represent the Kurdish will. He called upon the international community and Iraqi political factions to endorse a process devoid of interference, aiming for stability and democratic integrity.

In mid-March, KDP announced a likely boycott of the upcoming elections in response to a Supreme Court ruling reducing Kurdistan Parliamentary seats to 100. This decision eliminated minority quota seats, exacerbating tensions between federal and regional authorities.

int'l monitors to observe elections

Kurdistan Prime Minister Masrour Barzani on Tuesday invited observers from around the world to monitor Kurdistan Region's upcoming elections in order to secure a "transparent" process

Barzani received the United Nations Assistance Mission for Iraq (UNAMI) Head Jeanine Hennis-Plasschaert in Erbil on Tuesday.

He said in a post on X that he made it clear to the senior UN envoy that his cabinet fully supports "free, fair and credible elections removed from constitutional violations and interference."

"[I]invite international electoral monitors/observers to secure a fair, credible and transparent process," he added.

The Kurdistan Region will hold parliamentary elections on June 10, two years after the original date they were scheduled for. The elections were postponed several times due to disputes between political parties and legal causes.

US State Department Spokesperson Matthew Miller on Monday said that Washington encourages the holding of "free, fair and credible elections."

Midnight on Sunday was the deadline for political parties to submit their candidates lists to Iraq’s Independent High Electoral Commission (IHEC) which is overseeing the process.

Most political parties submitted their candidate lists, excluding the ruling Kurdistan Democratic Party (KDP), which earlier this month announced it was boycotting the vote in protest over a federal court ruling that eliminated minority quota seats and imposed a four-constituency system.

The party’s politburo said that the court ruling came as a continuation of the latter’s “unconstitutional rulings against the Kurdistan Region in the past four years” and called it an attempt to “return Iraq to a centralized system.”

Prime Minister Barzani is the second deputy to the KDP Leader Masoud Barzani.

"We also agreed to tackle the roadblocks in ways that protect the democratic process and stability of the Kurdistan Region," the Kurdish premier noted on Tuesday.

The KDP is the largest Kurdish party and the dominant force in both Erbil and Duhok provinces. Its withdrawal from the election has led many pundits to speculate that the vote may not be held as scheduled in June.

International allies and observers have warned against postponing the elections. On Saturday, United States Ambassador Alina Romanowski met with KDP leader Masoud Barzani and top KRG officials to discuss the vote.

Ongoing Disputes with Baghdad

Kurdistan President Nechirvan Barzani is set to lead a high-level delegation to Baghdad on Sunday, aiming to address the lingering issues between Erbil and the Iraqi capital

During his visit, the Kurdish president will engage in separate discussions with Iraqi Prime Minister Mohammed Shia’ al-Sudani and representatives from the Shia-led State Administration Coalition, a key player in the current cabinet formation process.

Among the pressing topics slated for discussion are the challenges surrounding the salaries of Kurdish public employees and the resumption of oil exports from the Kurdistan Region via Turkey’s Ceyhan port. These issues have been sources of contention between Erbil and Baghdad, requiring concerted efforts to find mutually acceptable solutions.

Additionally, the forthcoming parliamentary elections in the Kurdistan Region will feature prominently on the agenda. As preparations for the elections progress, ensuring their fairness and integrity remains a priority for both regional and federal authorities.

Moreover, discussions will focus on reaching a consensus between the Kurdistan Regional Government (KRG) and the federal government regarding the Region’s share of the national budget.

Erbil has faced obstacles in securing its rightful financial entitlements, with Baghdad accused of violating constitutional provisions and undermining the Kurdistan Region’s economic stability.

Electoral Fraud Ahead of Elections

The Kurdistan Democratic Party (KDP) has launched an intel investigation into a significant number of its members whose fingerprints are not recognized by the Independent High Electoral Commission (IHEC)

According to the preliminary results, out of a total of 400,000 unrecognized individuals, 200,000 are members of the KDP, with 160,000 of them located in Sulaimaniyah.

Shuan Kalari, a prominent figure within the KDP faction, disclosed to VOA Kurdish that the party has identified these individuals through an extensive database of its members' fingerprints available at the IHEC, which were not recognized by the commission.

Kalari emphasized that despite the propaganda campaign targeting the KDP, claiming some of these individuals are refugees from Syria and Iran, the majority are indeed members of the KDP, with a significant portion residing in Sulaimaniyah.

"The KDP has not formally declared intentions to boycott or abstain from the elections. We are fully prepared for the electoral process. However, certain concerns need to be addressed before proceeding,” Kalari highlighted the KDP's stance.
